Utah's new DUI Law dropped the BAC (blood alcohol concentration) level from 0.08% to 0.05% in January of this year. I have posted about the new law several times. The Utah Highway Patrol recently released some statistics from January of this year regarding the 0.05% DUI Arrests. According to the Deseret News: A total of 844 people were arrested for investigation of DUI in January,[...]
A new study has been published by the American Public Health Association stating that Utah's new 0.05% BAC DUI Law is ethically acceptable. Here is an excerpt from the study: “Ultimately, our analysis suggests that BAC [blood alcohol content] 0.05 laws are ethically desirable because they are likely to prevent substantial harm with minimal restrictions,” wrote Stephanie Morain, [...]
Early on Tuesday January 1st, New Year's Day a Wyoming man was stopped in Coalville. The officer smelled alcohol on his breath and administered a breathalyzer test. The man blew a 0.089% BAC. He was brought back to the station and had the official breathalyzer test administered 90 minutes later. The man blew a 0.059% BAC, which is over Utah's new legal limit of 0.05%. According [...]
As usual the Utah Highway Patrol will be ramping up their DUI patrols for the New Year's weekend and Holiday. Also, the new DUI law of the 0.05% BAC will be going to effect on Sunday, December 30th. So the number of arrests will probably be going up. Here is what the Utah Highway Patrol had to say about the new 0.05% DUI law going into effect: The 2017 Utah Legislature passed [...]
Utah might be the first state to allow self driving cars. The House Transportation Committee approved a bill that would make these cars legal throughout Utah. Some Utah lawmakers think this will help ease the amount of DUIs people are charged with when the new 0.05% DUI Law goes into effect. The new bill, HB371 is being sponsored by Representative Robert Spendlove, R-Sandy, and it is aimed [...]
There is a new bill that has been introduced to congress that is trying to delay the new 0.05% BAC Utah DUI Law that goes into effect on New Year's Eve this year. According to Fox 13: Rep. Karen Kwan, D-Taylorsville, introduced House Bill 345 last week, which delays Utah's new .05 DUI law until at least 2022. It also includes some changes making it so immigrant drivers are not [...]
A U.S. commissioned report by the National Academies of Sciences has suggested that the entire country needs to lower the DUI BAC limit for driving from 0.08% to 0.05% just like how Utah has done. The new Utah law won't go in effect until Dec. 30th of this year, but the National Academies of Sciences has suggested the other 49 states follow suit. This would mean that most women could only [...]
Early this year I posted about an ad that the American Beverage Institute ran that compared Utah's new 0.05% DUI Law to driving while elderly. The ad featured many of the Utah government officials who voted to pass Utah's new 0.05% BAC limit. The American Beverage Institute isn't stopping there and has once again returned to Utah's Capitol Hill to make a case for the new law's repeal. [...]
The Utah Substance Abuse Advisory Council is investigating a tiered system of penalties for Utah drivers that are arrested for drunk driving under the upcoming 0.05% BAC Law, according to the Salt Lake Tribune. The group has spent months studying to see if lighter penalties for those convicted of DUI between the 0.05% and 0.08% BAC would be effective. The study found that giving these [...]
The American Council on Addiction and Alcohol Problems gave praise to Utah governor Gary Herbert recently for his signing of the new bill to lower the legal BAC level from 0.08% to 0.05%. "The standard in most if not all states is .08," says ACAAP president Rob Chambers. "What's interesting is that for those with a commercial driver's license the blood alcohol level is .04, but [this] will lower [...]
