Protecting You From The Harsh Penalties Of Possession
Charges for possession of marijuana are based on the amount of the drug alleged to be in possession, and can be enhanced by the existence of prior charges and/or convictions. Penalties also vary depending on whether yours is a case of “simple possession” or if you had marijuana with the intent to sell it. The following penalties apply based on weight of the drug:
- Less than one ounce: up to $1,000 fine and six months in jail
- Between one ounce and one pound: up to $2,500 fine and one year in jail
- Between one and 100 pounds: up to$5,000 fine and five years in prison
- More than 100 pounds: up to $10,000 fine and between one and 15 years in prison
Similar, albeit separate penalties apply for possession of drug paraphernalia like pipes or bongs. Again, penalties increase if you intend to sell the paraphernalia — especially if you sell to a minor.
