    Sobriety (DUI) checkpoints are used by Utah law enforcement as a way to catch drivers who may be driving under the influence of drugs or alcohol.

     

    Salt Lake DUI Checkpoint Defense

    The problem with these checkpoints is they are expensive (the cost of a checkpoint can be over $10,000 as opposed to a DUI Blitz which averages around $300) and not very effective as these checkpoints catch around one-third of possible drunk drivers.

    Do you have to stop at DUI Checkpoints / Roadblocks in Utah?

    The answer is complicated.

    Police choose at random which cars to stop. This can be one in every five cars, a random pattern the police choose, or if the driver looks suspicious. If police wave you through the checkpoint you do not have to stop. If the police do ask you to stop and you don’t you could be charged with disorderly conduct. If you have been drinking and police stop you at a DUI Checkpoint they have to have some additional evidence in order to arrest you.

    This additional evidence can be:

    • Odor of drugs or alcohol
    • Bloodshot or glassy eyes
    • Slurred speech
    • Slow motor skills
    • Admitting to using drugs or drinking alcohol

    If police find this additional evidence they then have the right to conduct sobriety tests, breathalyzer tests, or blood tests. If you fail any of these tests police then have the right to arrest you for driving under the influence.

    If you see a checkpoint and decide to do a u-turn and drive back the way you came the police will notice this and pull you over. The best thing to do is to continue driving through the checkpoint.

    Utah Law Enforcement often announce these checkpoints well in advance sometimes several days before. So if you want to avoid these DUI Checkpoints there is usually an option to take a different route.
