  • What Are The Sentencing Mandates For A DUI In Utah?

A conviction can have a significant impact on a defendant’s life, including his or her job, family and social life.     For someone’s first conviction for DUI, the court is required to:

     

    • Sentence the person to no less than 48 hours in jail; or
    • Require the person to use electronic monitoring for a sentence of home confinement; or
    • Require the person to complete at least 48 hours of compensatory work service.

    For someone’s second conviction for DUI, the court is required to:

     

    • Sentence the person to no less than 240 hours in jail; or
    • Require the person to use electronic monitoring for a sentence of home confinement; or
    • Require the person to complete at least 240 hours of compensatory work service.

    For someone’s third conviction for DUI within 10 years, the court is required to:

     

    • Sentence the person to jail or prison time of at least 1,500 hours.

    As you can see, there are mandatory minimum requirements for sentencing in Utah for a DUI.
