What Are The Sentencing Mandates For A DUI In Utah?

Driving under the influence is a serious crime in all 50 states. The potential for serious injury or death to the intoxicated driver and others is high. For someone’s first conviction for DUI, the court is required to:

• Sentence the person to no less than 48 hours in jail; or

• Require the person to complete at least 48 hours of compensatory work service.

For someone’s second conviction for DUI, the court is required to:

• Sentence the person to no less than 240 hours in jail; or
• Require the person to use electronic monitoring for a sentence of home confinement; or
• Require the person to complete at least 240 hours of compensatory work service.

For someone’s third conviction for DUI within 10 years, the court is required to:

• Sentence the person to jail or prison time of at least 1,500 hours.

As you can see, there are mandatory minimum requirements for sentencing in Utah for a DUI.
